SUBJECT: North Dakota Senate Bill 2212

Dear Naturist,
The Naturist Action Committee is closely monitoring the 2003 U.S.
state legislatures on behalf of naturists. We have recently
identified a situation in North Dakota that threatens the very core
of family naturism. NAC needs your immediate help.
THE THREAT
Senate Bill 2212 proposes to modify Subsection 1 of section
12.1-20-12.1 of the North Dakota Century Code. The revisions that would be made are shown in UPPER CASE letters in the following excerpt from the bill:
1. A person, with intent to arouse, appeal to, or
gratify that person's lust, passions, or sexual
desires, is guilty of a class A misdemeanor if
that person:
a. Masturbates in a public place OR IN THE
PRESENCE OF A MINOR;or
b. Exposes one's penis, vulva, or anus in a
public place OR TO A MINOR IN A PUBLIC OR
PRIVATE PLACE

Naturists should not take comfort in the wording that seems to
indicate an offense takes place only if there is intent to arouse,
appeal to or gratify sexual desires. Despite those words, this is the
section of North Dakota law used as a practical matter to prosecute
simple nudity. Sexual motivation is assumed to be associated with
nudity.
Why else would any anyone be nude, right?
This bill would criminalize nudity in the presence of a child and
makes no exception for nudity in naturist contexts or even for
household nudity among family members. Indeed, many lawmakers have
been led to believe that household nudity "softens up" a child for
acceptance of subsequent sexual abuse.
WHAT'S HAPPENING WITH THIS BILL?
SB 2212 was introduced in the Senate and has passed a floor vote
there without a single vote of opposition. It has been referred to
the House, where it is assigned to the Judiciary Committee. Naturists
must take a stand now.
WHAT CAN I DO?
The Naturist Action Committee needs your help now. NAC is asking
naturists everywhere, and especially those from North Dakota, to
write to members of the House Judiciary Committee, expressing
opposition to SB 2212. The members of the committee are listed below.
Please contact as many as possible.
WHAT DO I SAY?
Whether you call or write, be polite. Verbal attacks on lawmakers
are never productive.
Identify yourself. Anonymous contacts are disregarded. Contacts from
North Dakota residents are most valuable in this matter, but NAC is
asking ALL NATURISTS for help.
Identify the legislation you oppose. The bill is Senate Bill 2212.
Say clearly that you oppose it.
Briefly tell why you oppose the bill. NAC suggests that you mention
the benefits of family-friendly naturist and express your opposition
to a proposed law that would criminalize it.
Contact by email is an acceptable way of communicating with North
Dakota legislators.
Contact NAC with feedback you receive from lawmakers or their offices.
